Adhuri khwaishen

ATTACK ON DOCTORS IN STATE OF EMOTIONAL TRAUMA
Since medieval times, doctors and healers are known to be people of great respect and of fear, and while the fear and respect part is still intact with this profession it has got a new emotion attached to its name, i.e. Anger. While getting angry when you do not attain your desired wish is natural, but getting angry and restoring to violence on medical professionals while a life is unable to be saved despite their best efforts has seen high rise in recent years.
While we are going
through the current Pandemic, the efforts of medical professionals and public
at large has shown bit of a control on the spread of disease but just two years
back the situation was much more devastating. As the vast majority of public’s
movement was restricted to stop the spread of virus, the medical professionals
were the first in line to try and save the lives of infected people and the
world has been showing their gratitude towards the efforts of medical
professional. Medical professionals were tagged as heroes of the war, who faced
innumerable hardships including but not limited to violent attacks of public so
much so that the state governments-imposed jail term up-to 7 years for attack
on health care workers who are treating infected patients and while that does
sound assuring but it only happens post injury is inflicted and that too
depends on which state you are in as some states imposed a mere fine of Rs.
5,000/- and a jail term of up-to 1 year.
It may be easy to
think that need of the hour is to introduce a central law protecting healthcare
workers from violence but protection of healthcare workers is matter of state
legislation and states have power to introduce legislation as it deems fit for
protection of its healthcare workers and in absence of any special act if any
complaint is filed by a healthcare professional it is treated as complaint
filed by any ordinary citizen and no special preference is given to the
complaint whereas if the complaint is against any medical professional in
addition to Central Acts action is taken by medical authorities so far as to
cancellation of license to practice which a professional have worked hard to
obtain in the first place through various trials and tribunals.
A sad incident
recently took place in Rajasthan wherein a patient died while undergoing a
normal medical procedure, but the onlookers and relatives of the patient
protested against the Doctor so much so that a murder case was registered
against the Doctor and ultimately after gotten tired of threats against herself
and her family she chose to end her own life while trying to justify that the
patient died under normal circumstances and she did tried her best to save the
patient’s life. Medical professionals have been dragged, kicked, threatened
maimed and attacked by angry mob which has no face and while through video and
audio medium authorities do find on occasions people who are responsible but
not everyone involved is tried and even the fear of punishment and fine does
not stop such attacks from happening.
While the health care
community is asking a stringent act for their protection against physical
assaults there is no control over the verbal abuse which is faced by such
professionals every single working and non-working day, it has become a common
practice among educated and uneducated populous of the country to raise
questions on the competency of the health care community while all they have
been doing is being surrounded by death and despair around them, taking care of
a terminally ill patient or even a patient under mere fever is something which
requires a healer to soothe pain that the other person is feeling, and while it
cannot be quantified but is should not be seen with degrading eyes. The reason
why such people were given the name of healer in certain parts of the old world
was because they used to take away the pain and suffering of the person, while
the family of the sufferer used to keep a distance a healer went ahead to see
the ailment and try to soothe the pain. Even in this pandemic, many people left
their own family members to suffer in pain so that infection is not spread to
themselves and our healthcare professionals despite being total strangers took
care of everyone infected and while words of praise were given all around the
actual efforts even the government and the associations failed to recognize. No
incentive or rewards were granted to majority of healthcare workers many
promises which were made in the beginning of this war are long forgotten in the
middle of this war and while disheartened these healthcare workers have no
option but to move forward because it is the result of choices made by them,
work without any expectation of any reward/ recognition.
Many PIL have been filed in Supreme Court demanding the need of a central legislation for protection of healthcare professionals as while in other profession for a mistake there is a warning or a penalty or nothing in many occasions but in the profession of healthcare one mistake means stringent liability on you and most likely end of career of such professional. In absence of any dedicated central law many healthcare workers fail to move past filing of charge sheet against offenders and the community feels that a specialized act would deter violence against healthcare professionals and besides a new and improved legislation, appropriate and respectful communications between doctors and patients are also needed in a populous and lower-middle-income country such as India. Public-awareness programs and reassurance of the public at large are also important because people are mostly misguided by false information, while beliefs with no scientific basis may be accepted. Moreover, proper protection and security should be provided to medical centers and establishments.
A
healthcare professional is termed to be a equal to God, the legislation we need
does not require these professionals to be treated as God it just need to treat
them also as rest of the humans who are given benefit of doubt and are equally
protected not subjected to anger of a mob with no face and a proper authority
who will hear and respond to the concerns raised by these professionals.

Restraining of media houses, a suit by Bollywood
Recently the media in the name of broadcasting trending news is actually passing derogatory and defamatory remarks to bollywood industry as a whole without having any evidence to corroborate with the news which they are broadcasting and going to the extent of giving public the ‘truth’ on a certain date and time which is provided to public in advance so as to increase the viewership of their channels. Media houses instead of broadcasting the news took over the role of judiciary and forensic department of the country thereby providing the cause of death of a person and the person who is guilty of committing such an act. The issue arose after the demise of late actor Sushant Singh Rajput who was found dead in his apartment on 14th June, 2020, the demise was ruled out as suicide due to mental health issues by every media house in the country, a month later father of late actor filed First Information Report against the actor’s former partner (Rhea), her brother and others of abetting to his Suicide. This led central agencies to come into picture to investigate the money laundering issue which further led to Narcotics Control Bureau taking the charge to find out drug angle in the demise of late actor. The media coverage now changed their stand from death by mental issue to death due to black magic performed by the Accused (Rhea) ‘The Accused was found Guilty’, accused took all control of late actor finances by sipping him dosages of drugs in regular intervals which drove him to a stage of paranoia thereby killing himself in the end.
This led to full-fledged
investigation of Bollywood industry from drugs point of view, few name came
forward in the same investigating authorities summoned those whose names came
up during the investigation, the headlines were changed again to ‘Drugs,
Addiction and Bollywood’, ‘Drug Home Delivery’ etc. During the day media houses
were after celebrities asking them are you an addict or not because we got one
photo which can prove you are and by night the debate continuous that this
industry is filthy people sleep and wake up with drugs and all are peddlers.
Somewhere down the line Covid-19 Pandemic, collapsing economy and farmer’s
protest were unheard of. The Bollywood Drug Mafia report was carried out by
many leading news channels as the ultimate news to increase their TRP channels were now using highly derogatory
words and expressions for Bollywood such as “dirt”, “filth”, “scum”, “druggies”
etc.
In
the light of same bollywod industry retaliated by filing a Civil Suit in Delhi
High Court on 12th October, 2020 by prominent Bollywood industry
association and many producers, praying to the court to direct Republic TV, Mr.
Arnab Goswami and Mr. Pradeep Bhandari of Republic TV, Times Now, Mr. Rahul
Shivshankar and Ms. Navika Kumar of Times Now as well as social media platforms
to refrain from making or publishing irresponsible, derogatory and defamatory
remarks against Bollywood as a whole and members of Bollywood, and to restrain
them from conducting media trials of Bollywood personalities and interfering
with the right to privacy of persons associated with Bollywood. In the
complaint it has been mentioned that news channels have been "openly
flouting" the Programme Code framed under Section 5 of the Cable Television Networks (Regulation) Act,
1995 which states that No person
shall transmit or re-transmit through a cable service any programme unless such
programme is in conformity with the prescribed programme code mentioned under
Rule 6 of The Cable Television Networks
Rules, 1994, Rule 6(d) states that it should not contain anything
obscene, defamatory, deliberate, false and suggestive innuendos and half
truths, Rule 6(f) states it should not contain anything amounting to contempt
of court and many other. The suit mentions that Defendants shall not conduct a
media trail of their own and shall carry out healthy news reporting by not
intervening in the court’s investigation and not pass any derogatory remarks
against any person or industry as a whole.
Twelve
years ago India saw another media trial of Arushi Talvar Murder case the media
after a few months of death of Arushi Talvar and servant Hemraj decleared that
both the deceased were having an affair and upon knowing this the girl’s father
killed both of them. This verdict was passed on by media years before court and
CBI could draw the conclusion of the double homicide, The Supreme Court had also called out the media for acting as a
super investigating agency in the murder case. The famous Nanavati case which
shook India in 1957 was also a result of media trial because it deliberately
affected the mind of jury in the ongoing court trial thereby helping a
convicted Nanvati getting pardoned from court.
The issue is
not just with Indian media, take for instance Rideau Vs. Louisiana in which
American Supreme Court laid down the test of presumed prejudice, the case
involved a bank robbery, kidnapping of three of the bank employees and
subsequent murder of one of them. An interview of accused was telecasted for
three days wherein he was shown in jail confessing to his guilt thereby
affecting his right to fair trial, supreme court was of the opinion that even
before initiation of the trail the accused was declared guilty because the tape
was telecasted for three days where there was no lawyer to advice the accused
to stand mute. Another famous issue was of Bill Clinton Impeachment hearings,
in December 1998 the house of Representative voted to impeach President Bill
Clinton on the counts of perjury and obstruction of justice, all the media
houses in the country wrote this headline ‘Trail of the Century’, Ex-President
was guilty of perjury and sex perpetrator unfortunately for all the media
houses Clinton was acquitted by the Senate in February, 1999, just before the
century was over.

Corona (Anti-Virus) Virus
The year 2020 world was hit by a storm of Covid-19 or Corona-virus which saw millions of people affected by it worldwide. People across the globe were suggested to not go out of their houses maintain distance from others and keep washing one's hands. In order to minimize the death rate various Governments of the world announced lock-down in their respective countries. India saw Covid-19 cases in the Month of January and by mid March things started to close, by 25th March whole nation was under lock-down which is still prevalent in the country.
I grew up in a small town named Ajmer, situated in Rajasthan (India), wherein we like every other kid of 90's used to ride bicycle all the time whose heart was in cricket, watching legends like Sachin Tendulkar, Rahul Dravid, Rickey Ponting set life goals for us. We roamed freely had our fun here than gradually left the city in order to pursue further education, than getting some good job in big city. We were accustomed to the noises around us, noise of every machine, people shouting in streets to well dressed men and women in the premises of court (I am a practicing Advocate). We were used to seeing lot many people around us working day and night in order to get the best out of our lives.
When Virus hit India like all nations we also went under Lock-down, so I did very logical and emotional thing which comes in the mind of every migrant and every student staying outside of their home TO GET HOME AS SOON AS POSSIBLE. We all want to be with our loved ones soon as we get a holiday or when we are in crisis, I also saw this as an opportunity to go back to my home town and be with my parents and that's exactly what I did. I was happy to be back home but I also made sure that this time I have work to do, I have got responsibilities now and so I along with other people like me started working from home. The nation was quiet now fewer vehicles on road no noise of machines only the soothing voices of characters of Ramayana and Mahabharata.
Life was going good, whole family together after a decade it's funny how when we stay out all we want is to go home and when we are home all we want is to get out , but this time we were bound to stay indoors, together in order to save each other lives, so we did turns out we all were longing for that. We laughed, we fought, we screamed, we loved in the end all of us together finally.
While we were under Lock-down certain changes were hard to let go like the dogs were now on the street all the time, air felt bit fresh than it used to, the lake which can be seen from my roof somehow looked cleaner. We all were amazed by such changes and this was happening across the globe, the wild started to claim their territory which was snatched from them Earth started its healing process and it made me wonder who are we to take this planet as out own, we have been taught ever since we were kids that we are merely inhabitants and so are others, the ability to walk and talk somehow made us the conquerors of this planet and we did exactly what every conqueror do, Lay waste of the land.
I didn't realized the sheer agony of other species until I started hearing again the noises of machines cars honking etc. with the coming of lifting up of Lock-down completely people have started again to conquer what was supposed to be a mere rental place. Few days back I was happy listening to birds chirruping, dogs barking breathing fresh air but now all I hear are the annoying noises of cars horns, heavy tractors etc. and yes it really is annoying.
All of this makes one wonder, what was it in the year 2020 that made it seem short and long both at the same time, short as we are not constantly running towards making till the end of the day every day and long as we can't wait to go out again. But still one needs to look for the hidden message like there is one in every treasure map, is Covid-19 a message to us that we need to stop take a deep breath we can take it slow or that humans are the virus eating this planet from within and Covid-19 is an Anti-virus just what the planet needed.

The child in you!!
Child's mind isn't affected by Ego/attitude so he/she tends to learn always, but as we grow older our minds gets affected by all those things which intrigues' our interest. Even once God's favourite Angel fell victim to these and thus was casted out of heaven.... How the mighty have fallen Alas!!.
Now my point being about all this crap is not to fall victim of greed, ego or power protect your heart, believe your instinct because second thoughts always result in doom... You are only human my friend but sure you can protect the one thing which will protect you.. Call it insurance. 😊
